Brief Description
The Films and Publications Amendment Act (Act 11 of 2019) gives sufficient agency to those who suffer from violence facilitated by or through ICTs. It criminalizes non-consensual intimate image distribution of a person’s private sexual photograph/s or film/s with the intention of causing that individual harm. The Act compels ISPs to provide the Film and Publications Board and the South African Police Service with details about the perpetrator. The amendments prohibit the distribution of private sexual photographs and films, through any medium including the internet and social media, without the consent of the individual appearing in such photographs and films and if the distribution is made with the intention of causing that individual harm.
